Terms of Sale
Last updated: 3 August 2026
These Terms of Sale apply to all purchases made through the mytyre.eu online store. Please read them carefully before placing an order.
Seller information
1. Parties and scope
These Terms of Sale (Terms) govern every purchase made through the online store at mytyre.eu (the Store), operated by the Seller identified in the Seller information box above. They apply to every natural person who purchases goods from the Store primarily for personal, non-business use (the Customer, you).
By placing an order in the Store you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy and Cookie Policy.
2. Contract formation
Products displayed in the Store are an invitation to make an offer, not a binding offer by the Seller. By submitting an order and completing checkout, you make an offer to purchase the selected products.
A binding sales contract between you and the Seller is formed only when the Seller sends you an order confirmation by email. If the Seller is unable to accept an order, for example due to a stock or pricing error, the Seller will notify you and no contract is formed for the affected item.
3. Prices, currency and payment
All prices shown in the Store are in euros (EUR) and include Estonian value-added tax (VAT) at the applicable statutory rate, currently 24%. The final price and applicable VAT are confirmed at checkout before you place your order.
Despite reasonable care, a product may occasionally be listed at an incorrect price due to a technical or human error. If the Seller discovers such an error before the order is confirmed, the Seller will inform you and give you the option to purchase the product at the correct price or cancel the order free of charge.
Payment is made at checkout by card or bank transfer, processed by licensed Estonian payment service providers supervised by the Estonian Financial Supervision Authority (Finantsinspektsioon), which may include LHV Pank AS. The Seller does not receive or store your full card number or other sensitive payment card data — these are handled exclusively by the payment service provider.
4. Product information and EU tyre label
Each product page displays the manufacturer-supplied EU tyre label information where available, including fuel efficiency class, wet grip class and external rolling noise, in accordance with EU Regulation 2020/740 on the labelling of tyres.
The Seller takes reasonable steps to ensure product descriptions, images and specifications are accurate, but minor discrepancies (for example packaging changes made by the manufacturer) may occur and do not by themselves entitle you to a discount, unless the product delivered does not conform to the contract.
5. Delivery
The Store currently delivers only within Estonia. Estimated delivery times are shown on each product page and are indicative, based on supplier stock and courier schedules; they are not guaranteed delivery dates unless expressly confirmed in the order confirmation.
Risk of accidental loss of or damage to the goods passes to you once the goods are delivered to you, or to a person indicated by you other than the carrier, in accordance with the Estonian Law of Obligations Act (Võlaõigusseadus).
If delivery is delayed materially beyond the estimated period, please contact us using the email address in the Seller information box; you may be entitled to set an additional reasonable delivery period and, if it is not met, to withdraw from the contract.
6. Right of withdrawal (14 days)
If you are a consumer purchasing for personal use, you have the right to withdraw from the sales contract within 14 calendar days, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights and section 56 et seq. of the Estonian Law of Obligations Act (Võlaõigusseadus).
The withdrawal period expires 14 days from the day on which you, or a third party indicated by you other than the carrier, acquires physical possession of the goods, or, for orders split into several deliveries, from the day the last item is received.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement (for example a letter sent by post or an email to info@mytyre.eu) before the withdrawal period expires. You may use the model withdrawal form below, but this is not mandatory.
If you withdraw from the contract, we will reimburse all payments received from you, including the standard delivery cost (excluding any extra cost if you chose a delivery method other than the least expensive standard option we offer), without undue delay and in any event within 14 days from the day we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent them back, whichever is earlier.
You must send back or hand over the goods without undue delay and in any event within 14 days of communicating your withdrawal. You bear the direct cost of returning the goods.
To qualify for a full refund, tyres must be returned unused, unmounted, undamaged and in their original packaging, in a condition allowing them to be resold as new. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning — for example, tyres that have been mounted, driven on or otherwise used. In such cases the refund will be reduced by the amount of the diminished value rather than refused outright.
The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, and other exceptions listed in the Law of Obligations Act, to the extent applicable.
7. Model withdrawal form
If you wish to withdraw from the contract, you may complete and send the information below (this model form reflects Annex I(B) to Directive 2011/83/EU; using it is optional).
- Addressee: see the Seller information above (name, address if provided, and email)
- I/we hereby give notice that I/we withdraw from my/our contract of sale of the following goods
- Ordered on / received on
- Name of consumer(s)
- Address of consumer(s)
- Signature of consumer(s) (only if this form is notified on paper)
- Date
8. Warranty and liability for defects
The Seller is liable for any lack of conformity of the goods that exists at the time of delivery and becomes apparent within two years thereof, in accordance with the statutory conformity guarantee under the Law of Obligations Act and Directive (EU) 2019/771. For defects that appear within the first year, it is presumed, unless proven otherwise, that the defect already existed at delivery.
If the goods do not conform to the contract, you are entitled, depending on the circumstances, to have the goods repaired or replaced, a proportionate price reduction, or to withdraw from the contract, free of charge.
Any additional manufacturer's warranty offered on specific tyre models is separate from, and does not replace or limit, your statutory rights described above.
9. Complaints and dispute resolution
If you believe a product is defective or your order was not fulfilled correctly, please contact us at info@mytyre.eu with your order number and a description of the issue. We will respond within a reasonable time and no later than 15 days.
If we cannot resolve a complaint directly, you may refer the dispute to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon), operating alongside the Consumer Protection and Technical Regulatory Authority (www.komisjon.ee, www.tarbijakaitseamet.ee), or use the European Union's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
10. Limitation of liability
To the extent permitted by law, the Seller's liability for damages arising from the sales contract is limited to foreseeable, direct damages related to the specific order.
Nothing in these Terms excludes or limits the Seller's liability for death or personal injury caused by negligence, for fraud or gross negligence, or for any statutory consumer-protection rights that cannot be limited or waived under Estonian or EU law.
11. Force majeure
Neither party is liable for delay or failure to perform an obligation caused by circumstances beyond its reasonable control, including natural disasters, war, strikes, transport disruptions or supplier failures, for as long as such circumstances persist.
12. Amendments to these Terms
The Seller may update these Terms from time to time, for example to reflect changes in law or business practice. The version in force at the time you place an order applies to that order. Material changes will be announced in the Store with reasonable notice before they take effect.
13. Governing law and jurisdiction
These Terms are governed by the law of the Republic of Estonia. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence.
Any dispute that cannot be settled amicably or through the bodies referred to above may be submitted to the competent Estonian court, without prejudice to any mandatory jurisdiction rules protecting consumers.
14. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects its intended purpose.
